Permissions to hold public charitable collection

 

Section 119 of the Civic Government (Scotland) Act 1982 regulates Public Charitable collections, either in a public place or by means of visits from place to place.

Any person who wishes to organise a public charitable collection within West Lothian is required under the above Act to submit an application at least 35 days prior to the collection . An application for permission under this section must be made in writing to West Lothian Council by the organiser of the collection not later than 35 days before the date of collection , or within such other period as the council may fix.

Note: Where less than 35 days notice is given, the council cannot guarantee that an application will be determined in time for the collection to take place.

The above does not apply to a collection, which takes place in the course of a public meeting, or to a collection, which takes place by means of unattended receptacle kept in a fixed position in a public place. Any person who organises a public charitable collection where permission has not been given shall be guilty of an offence.
